Tree Protection
The City of Melbourne does not have authority over trees on private property. However, trees throughout the municipality may be protected by the following controls:
Planning Schemes
Significant Tree Register
The City of Melbourne maintains a Significant Tree Register that includes trees deemed historically, aesthetically, scientifically, or socially significant.
DBH and Height Requirements: The register is based on criteria other than size; trees are listed for their significance.
Tree Removal Permits
A permit is required to remove, prune, or conduct works within the Tree Protection Zone (TPZ) of significant trees.
The assessment for permit applications includes factors like tree health, structural condition, biodiversity, and mitigation of the urban heat island effect.
Penalties
Unauthorised removal or damage to protected trees can result in significant fines.

As a homeowner, architect, builder, landscaper or realestate agent, you’ll need to be up to speed with the tree protection laws that are put in place by The City of Melbourne. These requirements outline the regulations in place to protect trees in your area. If you plan to prune or remove a tree, or undertake any construction works in the vicinity of a tree, you may be required to obtain a permit from the council to do so.
